TELECOMMUNICATIONS ACT, 1996 (ACT NO. 103 OF 1996)

REGULATIONS IN RESPECT OF THE ANNUAL CONTRIBUTIONS TO THE UNIVERSAL SERVICE FUND BY HOLDERS OF TELECOMMUNICATION SERVICE LICENCES

In terms of section 96(6) of the Telecommunications Act, 1996 (Act No. 103 of 1996) I, Ivy Matsepe-Casaburri, Minister of Communications, hereby approve and publish the regulations in the Schedule made by the Independant Communications Authority of South Africa in terms of section 96 read with section 67 of the said Act.

SCHEDULE

Definition

1. In these regulations a word or expression to which a meaning has been assigned by the Act, shall have the meaning so assigned unless the context indicates otherwise,-

"The Act" means the Telecommunications Act of 1996 (Act No. 103 of 1996)

"The Fund" means the Universal Service Fund

Contributions payable by licence holders to the Universal Service Fund

2(1) Every holder of a licence issued or deemed to have been issued in terms of Chapter V of the Act, shall pay an annual contribution of 0.2% of the annual turnover derived from the provision of telecommunication service that it is licensed to provide, to the Fund.

(2) Holders of Licences in terms of section 40A and section 41 of the Act shall pay an amount of One Rand (R1,00) as an annual contribution.

Payment

3(1) Contributions to the Fund in terms of regulation 2 shall become due and payable in full on 1 July of each year. The first payment shall be due on 01 July 2004.

(2) Payment in terms of regulation 2 shall be calculated based on the licensees audited financial statements for the preceeding year.

Repeal

4. Government Notice No. 729 of Government Gazette No 20162 dated 4 June 1999 prescribing regulations relating to the contributions to the Universal Service Fund and the apportionment thereof, is hereby repealed.
